How Can I Track Down a Spammer?

Some spammer is using my e-mail address as the return address for his mass
mailings for "bump and dump" scams.
Some days I get hit with thousands of rejected e-mails.
I would "sue the bastard" for common law passing off if I could identify
him.
What, from a technical perspective, would I need to do to track down the
spammer?

In a pump-and-dump scheme the spammer does not get direct benefit from the
spam run. So the pump-and-dump spams do not require the spammer to provide
some means of contacting the spammer, which can be tracked down.
Several years ago the SEC did have some success in chasing down and
prosecuting the pumpers, but for technical violations only: they were not
disclosing the fact that they own a good chunk of the float, and stand to
benefit from a dump at pumped prices. Since then, the pumpers wisened up
and began appending disclaimers to their spams.
If you can grab the original spam from your bounces, you should examine
their disclaimer to ascertain what relationship the company that's getting
pumped has with the pumpee. Quite often you will find that the company paid
the pumpee, in stock, for the pump.
The next step is to write a letter, a real letter, not E-mail. Write it to
the company attention, and Cc: it to SEC's general consumer complaint
address (and indicate so on your letter).
In your letter, explain briefly your situation. Make sure to point out that
the pumpee is acting as an agent of the company, and that you believe that
this makes them liable for what you consider to be wire fraud and identity
theft. End your letter with a request to stop this immediately, and to
reply back with the contact details for the "promotional company" their
hired to run the pump, so that you can take your beef with them directly.
And if they choose not to respond, you will therefore conclude that they do
not dispute any of your allegations, and acknowledge that they are
responsible for their promoter's actions.

I was wondering if there is any way to trace the e-mails back to their
sources, even if it required subpoenas to do it. I would prefer to bring
the action in state court in front of a home-town jury.

You could start by posting a selection of the bounces you have
received, all from different domains, without the actual
bounced body. About 6 of them will do.
That way we can see if you are telling the truth or are just
another spammer looking for tips on how to avoid being tracked
down.

OK, here are a few of the THOUSANDS I have saved (with email addresses
redacted). This latest batch all come from the same message (as shown
below). However, I have many different variations on the same theme. A
few mention GEM, Inc. others do not.

You run your MTA with root permissions?
How are we supposed to check the validity of those out with
the email addresses altered (rather than munged)?
Assuming they are valid, just have your filter dump any
bounces from addresses 'you' haven't mailed. Or change 'your'
address(es).
What else do you think you can do? Track down the spammer and
pummel him and hold him until the sheriff arrives?
I don't read the posts of "Sam" or any of his sockpuppets,
not even the subjects, which are changed to XXXXXXX before
reaching my newsreader. Same for any replies to them.

Beavis (aka Alan Connor) is religious in his belief that C/R
(challenge/response) is the ultimate in managing an email account.
Since a Challenge is, in effect, the same thing as a bounce, he doesn't
like it when people talk about receiving a lot of bounces as a result
of spammer forgery. It's an affront to his religion, because one of the
tenants of his religion is that spammers don't forge real addresses in
spam. He won't admit that Challenges can be abusive email, and he now
hates your guts (he's crazy) for having first hand info that his
religion is bogus.
I certainly believe you. There's probably nothing you can do about
what has happened to you. But if you want to get some comic relief out
of this, go ahead and post some of the bounces. I predict that Beavis'
comments will be jaw-dropping.

Beavis thinks you're up to something. Actually, he *knows* you must
be up to something, because, according to his religion, spammers don't
forge legit addresses in spam.

It would be very interesting to see Beavis' reaction if he started
getting thousands of bounces. I think he'd freak out and start babbling
about "Sam". As it is, he regularly posts some sort of log about the
routine spam his filter sends to dev/null, he thinks it's a big deal,
or something.

Beavis seems to be admitting that spammers do forge the addresses of
actual email users. His meds must have just kicked in.

Like I said, Beavis is crazy. He thinks I'm Sam. He thinks everyone

Lots of money.
"Joe-Jobbing" happens all the time, and to large companies too (like IBM.)
They don't bother going after anyone but the most egregious offender, because
it's too expensive.

Sam's posts are the only convincing argument I've ever seen for
responding to trolls. When 'Alan Connor' (aka Usenet-Beavis) actually
responds to the questions repeatedly asked of him, maybe we'll see an
end to this. Or maybe someone will just turn up the heat. At the end of
the day, it get's really dark.
I know one thing for sure though. If things don't change around here
soon, they'll stay the same as they are.
